REGARDING ELECTRONIC TICKETS ISSUED BY NORLANDAIR

NOTE: The provisions of the Warsaw Convention may apply if the journey of the passenger is to another country. In general, the Warsaw Convention provides for and limits the liability of aircraft carriers for death or injury, together with the loss or damage of baggage. In the case of domestic carriage, the provisions of the Aviation Act on limitations to liability apply. For further details, see: Notifications of limitations to liability.

Reservation: In the event of contradictory information between languages, the Icelandic version shall apply.

CONTRACT TERMS AND CONDITIONS
1. In the agreement, the term Warsaw Convention means the convention for the unification of certain rules relating to international carriage by air, which was signed in Warsaw on 12 October 1929, as amended in The Hague on 28 September 1955, cf. Act No. 41/1949, as amended. The Aviation Act means the Aviation Act No. 60/1998, as subsequently amended.

  1. Carriage according to e-tickets issued by Norlandair is subject to the rules and limits to liability determined in the Warsaw Convention, except in cases where the carriage is not international according to the Convention. In the event of domestic carriage, such carriage is subject to the rules and limits to liability determined by the Aviation Act.
  2. To the extent that such does not contravene the above provisions, the carriage and other services provided by an airline is governed by: (I) effective price lists, (II) these terms of carriage, (III) luggage receipts and boarding passes.
  3. Each exception or limit to the liability of an airline shall apply to and cover the agents, employees and representatives of the airline, as well as to the owners of the aircraft used for the carriage, their agents, employees and representatives.
  4. Checked-in luggage is returned to the holder of the luggage receipt. In the event of loss or damage to luggage, the airline must be notified of such event in writing as soon as such loss or damage becomes apparent or not later than seven days after receiving the luggage. Complaints must be submitted within 21 days of the delivery of luggage for transportation in the event of delayed delivery of luggage.

  1. Electronic tickets (e-tickets) issued by Norlandair remain in effect for one year after their date of issue, unless otherwise specified in the terms and conditions of the airfare, carriage terms or similar rules. Airfares according to e-tickets issued by Norlandair are subject to changes that may occur prior to the date of departure. An airline may refuse carriage if the effective airfare has not been paid.
  2. Norlandair undertakes to make every effort to transport passengers and their luggage in accordance with schedules. If necessary, the airline may change carriers or transport companies without notice. Schedules can be changed without notice, and stopovers, as stated on airline tickets, may be cancelled, if necessary. Schedules can be changed without notice. The airline is not responsible for ensuring that a passenger makes a flight connection unless the flight legs have the same flight numbers. The airline is not responsible for the cancellation of a flight due to uncontrollable events. These include weather conditions, terrorism, political acts, wars, natural disasters, fires, strikes and other conditions beyond the airline’s control.
  3. Passengers are under obligation to fulfil the provisions of laws and regulations pertaining to travel, to submit departure and arrival documents and other necessary ID and to arrive on time to the airport, as stipulated by the airline, or if no time is specified, early enough to have the time to complete departure preparations.
  4. No agent, employee or representative of the airline is permitted to alter, adjust or cancel any provision of these carriage terms and conditions.
  5. In the event that a flight is sold by the airline acting as agent for another airline, and such flight is performed by the latter airline, the latter airline is responsible for all aspects relating to such flight in accordance with the airline’s terms and conditions and the applicable laws, rules and international conventions as current as regards loss or damage, such as to the passenger’s person or luggage, injury and delays or cancellation of the flight.
  6. Behaviour on board an aircraft: In the event that the airline is of the opinion that the behaviour of a passenger may cause other persons or on-board property harm or may obstruct the crew from carrying out its duties; in cases where the passenger does not follow the instructions of a representative or employee of the company, e.g. in connection with smoking, alcohol or consumption of drugs; or if the passenger’s behaviour in some manner causes other passengers or employees discomfort, the airline is permitted to employ the measures it deems necessary to prevent continued disruption. This may, for instance, involve the use of restraints. In such case, the passenger may be denied permission to board a connecting flight and may be prosecuted for violations committed on board the aircraft. Norlandair reserves the right to deny carriage to any party who has obtained a ticket in violation of applicable laws or the price lists of the airline, rules and regulations. This also applies to tickets obtained by means of stolen payment or credit cards, etc.
  7. EU 261/2004 Compensation Claims

12.1 This clause applies to claims for compensation under EU Regulation 261/2004 and Icelandic Regulation No. 1048/2012.

12.2 Passengers must submit claims directly to Norlandair and allow Norlandair 30 days to respond directly to the claims before engaging third parties to make a claim on their behalf. This does not apply to passengers who do not have the capacity to submit claims themselves, such as children.

12.3 Norlandair will not process claims submitted by a third party, on behalf of passengers, if the passenger concerned has not submitted the claim directly to Norlandair and allowed Norlandair 30 days to respond.

12.4 A passenger may submit a claim to Norlandair on behalf of other passengers on the same booking provided that the passenger has the consent of other passengers on the booking to submit a claim on their behalf.

12.5 Passengers are not prohibited by this clause from consulting legal or other third party advisers before submitting a claim in accordance with this clause.

12.6 Any payment or refund will be made to the payment card used to make the booking or to the bank account of a passenger on the booking.

Notification of limitations to liability

International flights:
Passengers travelling to destinations other than their country of origin are hereby informed that the journey may be subject to the provisions of the Warsaw Convention, including those that relate to limitations of liability for death, physical injury or damages to luggage. As a rule, it is possible to obtain extra insurance by purchasing insurance from an insurance company. Limitations to the airline’s liability do not have an impact on such insurance.

Domestic flights:

  1. Rules on physical injury
In the event that a passenger dies or suffers physical injury or damage to health caused by an accident and the carrier can provide evidence that the person suffering the loss or damage caused or was involved in the cause of the loss or damage, compensation may be reduced or cancelled. Under the same conditions, the carrier is freed from liability if he can provide evidence that he and his employees have taken all the necessary precautions to prevent the loss or damage or that such loss or damage was outside their control.

The aircraft operator, however, may only rely on the latter defence if the principal of the covered loss or damage amount exceeds the equivalent of SDR 100,000 in ISK and may only do so as regards the part that exceeds the previously stated amount limit.

The aircraft operator shall, without delay and not later than 15 days after the identity of the injured or deceased party became clear, make a prepayment to meet acute financial needs. The payment shall take circumstances into account. This payment shall not be less than the equivalent of SDR 15,000 in ISK for each passenger in the event of a fatal accident. Such prepayment, however, is not equivalent to admission of liability and will be used for deduction in the final settlement of claims for the accident. The prepayment is also reversible if the aircraft operator can prove that the passenger caused or was involved in the cause of the accident or that the person receiving the payment was not legally entitled to such payment.

  1. Rules on limitations to liability as regards luggage
Liability due to the loss, delay or damage to luggage is limited as stated herein unless a higher value is stated in advance and additional fees are paid: The liability of the carrier in the event that luggage is lost, destroyed, damaged or delayed shall be limited to SDR 1,150 for each passenger, unless the passenger, on checking in the luggage, specifically provides information on the interests dependent on the delivery of the luggage at the destination and pays the requested extra fee. In such case, the specified value applies as the maximum liability of the carrier, unless he can show that the actual interests of the passenger were lower. Stating the extra value of individual items is permitted.

3.Luggage
Circumstances may arise where luggage has to be left behind due to weight or space limitations imposed on the aircraft. This may apply to luggage for which the passenger has already paid.

  1. Overbooking
Flights may be overbooked, and the situation may arise where there is no free seat in a flight for which a booking has been confirmed. Those who are left behind in such circumstances are entitled to compensation.
  2. Pregnant mothers
Expectant mothers who are in the final month of their third trimester may only travel with the carrier if they submit a medical certificate, issued within 72 hours before departure, which confirms that they are not at risk with respect to air travel.
